Introduction and Purpose

This document outlines the principles, guidelines, and requirements of the Acceptable Use Policy (AUP) of Yana Investment CC, governing the use of Yana Investment CC’s services and products (“Services and Products”) by the Customer (“Customer”). The purpose of Yana Investment CC’s Acceptable Use Policy is to comply with all applicable local, regional, and international laws while ensuring server security, service availability, physical security, Customer privacy, and the overall integrity of the services provided by Yana Investment CC.

Yana Investment CC reserves the right to enforce reasonable rules and regulations regarding the use of its services. These rules and regulations are subject to change as necessary. The AUP is not an exhaustive list, and Yana Investment CC reserves the right to update the policy at any time. Acceptance and execution of the Master Services Agreement bind all parties to the AUP at the time of contract execution and any future modifications. Any violation of this AUP may result in suspension or termination of the Customer’s account(s) or other corrective actions deemed appropriate by Yana Investment CC. No credits will be issued for service interruptions resulting from policy violations.

VIOLATION OF ANY SECTION OF THIS AUP IS STRICTLY PROHIBITED AND MAY RESULT IN THE IMMEDIATE TERMINATION OR SUSPENSION OF SERVICES PROVIDED BY YANA INVESTMENT CC.

1. Compliance with Law

Customers shall not post, transmit, re-transmit, or store material on or through any of Yana Investment CC’s Services or Products that, in Yana Investment CC’s sole judgment:

(i) Violates any local, regional, or international laws or regulations;

(ii) Is threatening, obscene, indecent, defamatory, or otherwise harmful to any individual or group;

(iii) Violates any intellectual property rights, including copyright, trade secret, or patent laws, such as distributing pirated software or unlicensed digital content.

Customers are responsible for ensuring compliance with all applicable laws when using Yana Investment CC’s Services and Products.

2. System and Network Security

Violations of system or network security are strictly prohibited and may result in criminal and civil liability. Yana Investment CC investigates all suspected violations and cooperates with law enforcement authorities where necessary.

Examples of system or network security violations include but are not limited to:

• Introduction of malicious programs (e.g., viruses, worms, Trojan horses, keyloggers) into Yana Investment CC’s network or servers.
• Security breaches or disruptions of internet connectivity, such as unauthorized access to data, port scans, denial-of-service (DoS) attacks, or distributed denial-of-service (DDoS) attacks.
• Circumventing user authentication or security of any host, network, or account.
• Engaging in any activity that interferes with or disrupts network operations.

Any Customers responsible for security breaches will bear the costs of recovery, billed at USD $100.00 per hour. Service disruptions resulting from network violations will not be eligible for service credits.

3. Internet Etiquette (Netiquette)

Customers are expected to adhere to widely accepted Internet etiquette, including:

• Complying with the rules of any network accessed through Yana Investment CC.
• Not posting or transmitting confidential or illegal materials.
• Avoiding content that is defamatory, obscene, or promotes unlawful activities.

Yana Investment CC reserves the right to suspend or terminate services for violations of this section.

4. Child Protection and Pornography

Yana Investment CC strictly prohibits hosting, transmitting, or distributing child pornography or any content violating child protection laws. Yana Investment CC will fully cooperate with legal authorities investigating such violations.

5. Copyright Infringement

Customers may only use Yana Investment CC’s services for lawful purposes. Transmission, distribution, or storage of copyright-protected materials without proper authorization is strictly prohibited. Customers are responsible for ensuring compliance with copyright laws, and Yana Investment CC will cooperate with law enforcement in cases of suspected infringement.

6. Hosting Policy

Customers must not use Yana Investment CC’s hosting services to:

• Promote unlawful activities or violate the AUP.
• Host phishing websites, spam-advertised sites, or facilitate unauthorized data harvesting.
• Store or distribute pirated software, scripts, or content that aids unlawful activities.
• Upload scripts that compromise server security, resulting in immediate suspension or termination.
• Use hosting accounts as storage spaces without active domain-based websites.

7. Website Security and Software Maintenance

Customers are responsible for maintaining the security of their websites. If a website is hacked, it will be suspended until vulnerabilities are addressed. Yana Investment CC does not restore backups of hacked sites unless proper security measures are implemented.

Customers managing online stores must:

• Maintain secure and updated e-commerce platforms.
• Ensure stored customer information is protected.
• Handle order processing, customer inquiries, and financial transactions securely.

If Yana Investment CC installs software for Customers, the Customer is responsible for ongoing updates and security maintenance.

8. Email Policy

Yana Investment CC maintains a strict zero-tolerance policy on spam (Unsolicited Commercial Email – UCE).

Spam is defined as:

• Sending bulk unsolicited emails, whether for commercial purposes or otherwise.
• Advertising services or websites through spam, including via IRC or USENET.
• Using Yana Investment CC’s servers to relay bulk emails without consent.

Violations of this policy may result in immediate suspension or termination of services without notice.

9. Enforcement and Consequences

Customers violating the AUP may face:

• Immediate suspension or termination of services without prior notice.
• Legal action, where applicable.
• Financial liability for damages caused by violations.

Yana Investment CC reserves the right to determine, at its sole discretion, what constitutes a violation of the AUP and to take necessary actions to enforce compliance.
